Terms of Service

PLEASE READ CAREFULLY: These Terms of Service ("Terms") constitute a binding legal agreement between you ("Licensee," "User," or "You") and ZNOWSOFT, LLC ("Licensor," "We," or "Us"), a limited liability company registered in the State of Wyoming, United States.
By purchasing, downloading, installing, or using the ZenSailor software (the "Software"), you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Software.
1. Definitions
- "Software" refers to the ZenSailor self-hosted Platform-as-a-Service solution, including its source code (where applicable), binary executables, command-line tools, agents, and documentation.
- "Instance" refers to a single installation of the Software on a physical or virtual server.
- "Subscription" refers to the recurring payment plan that grants access to Premium features.
2. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Software. If you use the Software on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. License Grant
Subject to your compliance with these Terms and payment of applicable fees, ZNOWSOFT, LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on servers owned or controlled by you.
- Free Version: You may use the Free (Community) version of the Software indefinitely, subject to the feature limitations described on our website.
- Premium/Pro License: Access to Premium features requires a valid, active Subscription. You may install the Premium version on the number of Instances specified in your purchase plan.
4. Restrictions on Use
You agree that you will not:
- Sell, resell, rent, lease, or sublicense the Software to third parties.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the proprietary components of the Software, except to the extent permitted by applicable law.
- Circumvent or attempt to tamper with the license validation mechanism or the telemetry reporting systems.
- Distribute modified versions of the Software that remove proprietary notices or branding.
- Use the Software to host, store, or distribute content that is unlawful, infringing, or harmful.
5. Telemetry and Updates
5.1 Telemetry Consent. You acknowledge and agree that the Software automatically sends usage and diagnostic telemetry to ZNOWSOFT, LLC. This telemetry is linked to your account: it identifies the email address of the owner account on your instance and the dashboard domain that instance is reached on, alongside feature usage, aggregate counts, version, performance and error information, as described in our Privacy Policy. It is used to improve the Software, to detect and prevent abuse and license fraud, and to support you. It does not export your source code, environment variables, secrets, application logs, databases, or any data held inside the containers you deploy. Telemetry can be switched off on any paid plan from Settings → Telemetry; Community instances report usage and diagnostics.
5.2 Automatic Updates. The Software may check for updates automatically. It is your responsibility to apply security patches and updates. We are not liable for security breaches resulting from your failure to update the Software.
6. Billing and Cancellation
- Fees: Fees for Premium Subscriptions are billed in advance on a recurring basis (monthly or yearly). All prices are quoted and charged in US Dollars (USD) only, and are processed through the ZnowSoft shop and its payment processor.
- Taxes: You are responsible for any applicable sales tax, VAT, or GST associated with your purchase.
- Cancellation: You may cancel your Subscription at any time via your account dashboard or the billing portal. Your license will remain active until the end of the current billing period; no partial-period refunds are issued except as stated below.
- Refund Policy: We offer a 14-day money-back guarantee on your initial purchase. Requests made after 14 days will not be refunded.
- Sales Restrictions: We do not sell paid Subscriptions to customers located in the European Union. Purchases determined to originate from the EU may be declined or refunded at the payment level.
7. Intellectual Property
All rights, title, and interest in and to the Software, including all intellectual property rights, belong to ZNOWSOFT, LLC. The Software is licensed, not sold. Any open-source components included in the Software are subject to their respective open-source licenses.
8. User Responsibility & Liability
8.1 Self-Hosting Risks. You acknowledge that you are installing this Software on your own infrastructure. ZNOWSOFT, LLC has no access to or control over your server. You are solely responsible for:
- Regularly backing up your data.
- Securing your server environment (firewalls, SSH keys, access controls).
- Compliance with laws regarding the content you host.
8.2 Indemnification. You agree to indemnify and hold harmless ZNOWSOFT, LLC and its officers, directors, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Software, the content you host using the Software, or your violation of these Terms.
9. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZNOWSOFT, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZNOWSOFT, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS (INCLUDING DATABASE CORRUPTION), OR SERVER DOWNTIME, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Wyoming, and the parties hereby consent to personal jurisdiction and venue therein.
12. Termination
We reserve the right to terminate or suspend your license and access to the Service immediately, without prior notice, if you breach these Terms (e.g., unauthorized sharing of license keys). Upon termination, you must cease all use of the Premium features and destroy all copies of the Software in your possession. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Governing Law) shall survive.
13. Changes to These Terms
We may update these Terms from time to time. The current version is always available on this page, and material changes will be announced with reasonable notice. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.
14. Miscellaneous
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and ZNOWSOFT, LLC regarding the Software and supersede any prior agreements. Our failure to enforce any provision is not a waiver of that provision. You may not assign these Terms without our prior written consent.
