PLEASE READ CAREFULLY: These Terms of Service ("Terms") constitute a binding legal agreement between you ("Licensee," "User," or "You") and ZNOWSOFT, LLC ("Licensor," "We," or "Us"), a limited liability company registered in Wyoming.
By purchasing, downloading, installing, or using the ZenSailor software ("Software"), you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Software.
1. Definitions
"Software" refers to the ZenSailor self-hosted Platform-as-a-Service solution, including its source code (where applicable), binary executables, and documentation.
"Instance" refers to a single installation of the Software on a physical or virtual server.
"Subscription" refers to the recurring payment plan that grants access to Premium features.
2. License Grant
Subject to your compliance with these Terms and payment of applicable fees, ZNOWSOFT, LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on servers owned or controlled by you.
Free Version: You may use the Free version of the Software indefinitely, subject to the feature limitations described on our website.
Premium/Pro License: Access to Premium features requires a valid, active Subscription. You may install the Premium version on the number of Instances specified in your purchase plan.
3. Restrictions on Use
You agree that you will not:
Sell, resell, rent, lease, or sublicense the Software to third parties.
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the proprietary components of the Software, except to the extent permitted by applicable law.
Circumvent or attempt to tamper with the license validation mechanism or the Anonymous Telemetry reporting systems.
Distribute modified versions of the Software that remove proprietary notices or branding.
4. Telemetry and Updates
4.1 Anonymous Telemetry Consent
You acknowledge and agree that the Software contains a feature that automatically sends anonymous technical data (as described in our Privacy Policy) to ZNOWSOFT, LLC. This data is used solely to improve the Software and prevent license fraud. This telemetry does not export your application data or databases.
4.2 Automatic Updates
The Software may check for updates automatically. It is your responsibility to apply security patches and updates. We are not liable for security breaches resulting from your failure to update the Software.
5. Billing and Cancellation
Fees: Fees for Premium Subscriptions are billed in advance on a recurring basis (monthly or yearly).
Taxes: You are responsible for any applicable sales tax, VAT, or GST associated with your purchase.
Cancellation: You may cancel your Subscription at any time via your account dashboard. Your license will remain active until the end of the current billing period.
Refund Policy: We offer a 14-day money-back guarantee on your initial purchase. Requests made after 14 days will not be refunded.
6. Intellectual Property
All rights, title, and interest in and to the Software, including all intellectual property rights, belong to ZNOWSOFT, LLC. The Software is licensed, not sold. Any open-source components included in the Software are subject to their respective open-source licenses.
7. User Responsibility & Liability
7.1 Self-Hosting Risks
You acknowledge that you are installing this Software on your own infrastructure. ZNOWSOFT, LLC has no access to or control over your server. You are solely responsible for:
Regularly backing up your data.
Securing your server environment (firewalls, SSH keys).
Compliance with laws regarding the content you host.
7.2 Indemnification
You agree to indemnify and hold harmless ZNOWSOFT, LLC and its officers, directors, and employees from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Software, the content you host using the Software, or your violation of these Terms.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZNOWSOFT, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZNOWSOFT, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA LOSS (INCLUDING DATABASE CORRUPTION), OR SERVER DOWNTIME, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Wyoming, and the parties hereby consent to personal jurisdiction and venue therein.
11. Termination
We reserve the right to terminate or suspend your license and access to the Service immediately, without prior notice, if you breach these Terms (e.g., unauthorized sharing of license keys). Upon termination, you must cease all use of the Premium features and destroy all copies of the Software in your possession.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SOFTWARE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
